Family Of Daughter Who Suffered Permanent Brain Damage During Childbirth At Ascension St. Thomas Midtown Hospital Awarded $46.9 Million By Jury In Birth Injury Lawsuit.
A jury in Davidson County Tennessee has reportedly awarded the family of 5-year-old girl $46,993,500 in a birth injury medical malpractice lawsuit that was filed against Saint Thomas Midtown Hospital, Tennessee Women’s Care and their family’s obstetrician. Several of the defendants had settled before trial.
In the afternoon of September 29, 2018 the child’s mother, Cayce Broughton, was admitted to St. Thomas Midtown Hospital for labor and delivery. According to reports, labor was prolonged and delivery did not occur until the next morning. The NICU apparently found that the baby, Vivian, had suffered from hypoxic ischemic encephalopathy. Hypoxic ischemic encephalopathy is a birth injury that is caused by a lack of oxygen to a baby, which can be the result of a prolonged labor. The child reportedly now suffers from cerebral palsy, brain damage and developmental delay, among other things.
The jury apparently found that two nurses and one doctor acted negligently, awarding $23 million in damages for future medical care and $20 million in damages for pain and suffering. The trial took three weeks.
