After a four day trial, the jury reportedly awarded the plaintiff $16 million for past lost income, medical expenses and mental anguish and $103 million for future damages. Florida law, however, apparently limits or caps the amount a plaintiff can recover from government agencies to $200,000 under the doctrine of sovereign immunity, unless a claim is made with the Florida legislature.
According to reports, the city of Gainesville argued that that the plaintiff failed to wear a seatbelt and that the driver of his vehicle was speeding.
