Minnesota Woman Files Acetaminophen Autism Lawsuit Against Walmart In Minnesota Federal Court After Her Child Was Diagnosed With Autism.

On August 2, 2022 a woman residing in Dakota County, Minnesota filed a lawsuit in the United States District Court for the District of Minnesota, styled Heather Strydom, Individually and as Mother, General Guardian of S.S, a Minor, v. Walmart, Incorporated, Personal Injury Case No. 0:22-cv-01934-KMM-DTS, alleging, among other things, that she began using acetaminophen (paracetamol) about 3-6 times a week to treat back pain and body aches in or around late 2016, when she was in the late stages of her pregnancy with her child, through 2017 when her child was born and that her child was subsequently diagnosed with autism in January 2021 at the age of three years old. According to the acetaminophen autism injury complaint, Plaintiff’s child is enrolled in early-childhood special education and will continue to require intensive speech and occupational therapy.

The acetaminophen autism lawsuit reportedly brings claims for: Strict Liability – Failure to Warn, Negligence, Breach of Express Warranty, Breach of Implied Warranty, Violation of Consumer Protection Laws, and Negligent Misrepresentation.

The Plaintiffs in the acetaminophen lawsuit reportedly seek, among other things, a judgment against Defendant Walmart and compensatory damages to Plaintiffs for past, present, and future damages, including pain and suffering for severe and permanent personal injuries sustained by Plaintiffs, permanent impairment, mental pain and suffering, loss of enjoyment of life, health and medical care costs, economic damages, together with interest and costs as provided by law, restitution and disgorgement, reasonable attorneys’ fees, past and future costs of all proceedings, and prejudgment interest on all damages.
