The plaintiff in a Los Angeles California medical malpractice wrongful death lawsuit recovered an award of $2,051,175, consisting of $1,727,175 in loss of support and spousal services, $74,000 in funeral expenses and $250,000 in non-economic damages after her husband died of cardiac complications from diabetic keto acidosis.
The medical malpractice lawsuit, styled Li Tong v. Po-Long Lew, D.O., reportedly alleged that the decedent visited the medical clinic of defendant, an osteopathic physician and family medicine doctor, after complaining of abdominal pain. The doctor reportedly advised the decedent to go to the hospital due to elevated blood pressure and blood sugar, but the decedent reportedly refused saying he couldn’t afford to go to the hospital.

The plaintiff’s expert reportedly testified, among other things, that the decedent’s elevated blood sugar required immediate transport to a hospital. The plaintiff reportedly alleged that the standard of care required that the doctor explain that the decedent’s life was in danger and that hospital treatment is mandatory and to refer him to a County hospital if cost was an issue. The defendant reportedly claimed that the treatment was within the standard of care.
