Parish of St. Tammany, Louisiana Residents File Belviq Breast Cancer Lawsuit in Louisiana Federal Court

On June 10, 2020 a couple residing in Parish of St. Tammany, Louisiana reportedly filed a Belviq breast cancer lawsuit in the U.S. District Court for the Eastern District of Louisiana, styled Stephanie Fuller and Robert Fuller v. Eisai, Inc., Eisai Co., Ltd., Arena Pharmaceuticals GmbH, Arena Pharmaceuticals, Inc., Case No. 2:20-cv-01675 alleging, among other things, that the plaintiff used Belviq to treat chronic weight management and subsquently suffered from breast cancer.

The Belviq breast cancer lawsuit reportedly alleges that on January 14, 2020, the FDA issued a safety communication regarding clinical trial results showing a possible increased risk of cancer with Belviq (known as lorcaserin hydrochloride).

The Belviq breast cancer case asserts causes of action for alleged negligence, strict products liability, breach of express warranty, breach of implied warranty, fraudulent misrepresentation, fraudulent concealment, negligent misrepresentation, fraud and deceit and  loss of consortium.

The Belviq breast cancer lawsuit complaint reportedly seeks judgment against the Defendants and an award of compensatory damages to Plaintiffs for past and future damages, including pain and suffering, mental anguish, disability, disfigurement, loss of ability to enjoy life, loss of ability to pursue happiness, and personality change, health care costs, medical monitoring, rehabilitation expenses, reasonable attorney fees and costs.
