Costco Acetaminophen Autism Lawsuit Filed In Minnesota Federal Court

California Mother Files Acetaminophen Autism Lawsuit In California Federal Court Against Costco.

On July 29, 2022 a mother residing in Riverside County, California filed a lawsuit in the United States District Court for the Central District of California, styled Abby Horowitz, Individually and as Mother, As Guardian Ad Litem of J.S. of C.C., Minors, v. Costco Wholesale Corporation, Personal Injury Case No. 5:22-cv-01336, alleging, among other things, that her two children suffered permanent injuries and significant pain and suffering, emotional distress, lost wages and earning capacity, and diminished quality of life as a result of prenatal exposure to Acetaminophen (also known as Paracetamol).

According to the Costco acetaminophen autism lawsuit complaint, over the course of her pregnancy with her children, and during all trimesters, she took over the counter Costco store brand acetaminophen products approximately three to six times a week for pain relief, believing it was safe during pregnancy.

One of her children was allegedly diagnosed with Autism in approximately April 2014 and receives special and individualized services from his school for Autism Spectrum Disorder (ASD) and requires an immense amount of assistance to complete the normal tasks of his daily life. Her other child allegedly has exhibited developmental delays, receives early childhood intervention and/or special and individualized services for ASD, displays stemming and other repetitive movements and also requires an immense amount of assistance to complete the normal tasks of his daily life.

The Costco acetaminophen autism lawsuit lawsuit reportedly brings claims for: Strict Liability – Failure to Warn, Negligence, Breach of Express Warranty, Breach of Implied Warranty, Violation of Consumer Protection Laws, and Negligent Misrepresentation.

The Plaintiffs in the acetaminophen lawsuit reportedly demand, among other things, a judgment against Defendant Costco and compensatory damages to Plaintiffs for past, present, and future damages, such as pain and suffering, permanent impairment, mental pain and suffering, loss of enjoyment of life, health and medical care costs, economic damages, punitive damages, restitution and disgorgement, reasonable attorneys’ fees, past and future costs of all proceedings, and prejudgment interest on all damages.
