A Florida Man and his Wife Obtained A $2,440,000 Jury Award As A Result of A Medical Malpractice Lawsuit Involving a Robot Assisted Prostate Surgery.

After an 8-day trial, 15th Circuit Court jury in Palm Beach County awarded a Florida man and his wife more than $2.4 million dollars in a medical malpractice personal injury lawsuit (Rosenberg v. Muhletaler, et al., 2019-CA-014940) alleging that the plaintiff suffered a rectal tear relating to a robot-assisted prostate surgery (or Prostatectomy) that led to other complications.

According to reports, the plaintiff claimed that his doctor failed to properly repair the rectal tear causing him to suffer from a rectourethral fistula (i.e., an opening between the rectum and urethra) which required surgical repair, an ileostomy and other complications. The defendant’s lawyer reportedly argued the doctor acted reasonably in repairing the rectal tear.
