Washington DC Resident Files Zantac Kidney Cancer Lawsuit Against Boehringer Ingelheim, Sanofi, Chattem, Pfizer, and GlaxoSmithKline.
On March 5, 2020 a Washington D.C. woman reportedly filed a personal injury lawsuit complaint against various manufacturers and/or distributors of Zantac (known generically as ranitidine) in the U.S. District Court for the District of Columbia, styled Robin S. McKinney v. Boehringer Ingelheim Pharmaceuticals, Inc., Sanofi US Services Inc., Chattem, Inc., Pfizer, Inc., and GlaxoSmithKline, LLC, Case No. 1:20-cv-00646 alleging, among other things, that she regularly ingested Zantac since 2002, ingesting the heartburn medication about 5-7 times a week on average, and thereafter developed kidney cancer (also known as renal cancer) and gall bladder stones and complications and underwent surgery in 2018 to have half of her left kidney and gall bladder removed. The plaintiff alleges that she was initially prescribed Zantac by her physician and subsequently ingested over-the-counter (“OTC”) Zantac.
According to the personal injury lawsuit complaint, the plaintiff was exposed to NDMA (semi-volatile organic chemical that forms in both industrial andnatural processes) which chemical the Environmental Protection Agency (“EPA”) and the International Agency for Research on Cancer (“IARC”) have classified NDMA as a probable human carcinogen. According to the Zantac renal cancer complaint, in certain animal studies examining the carcinogenicity of NDMA through oral administration, animals exposed to NDMA developed cancer in the stomach, liver, kidney, bladder, pancreas and other organs.
The Zantac kidney cancer lawsuit reportedly asserts legal claims for strict liability-design defect, strict liability-failure to warn, negligence, breach of express warranties, breach of implied warranties, and negligent misrepresentation.
The Zantac renal cancer lawsuit complaint reportedly seeks compensatory damages, punitive damages, pre- and post-judgment interest, and reasonable attorneys’ fees, court costs, and litigation expenses.
