Ovarian Cancer Hair Straightener Lawsuit Complaint Filed Against L’Oréal, SoftSheenCarson, Strength of Nature Global and Namaste Laboratories

A Missouri Woman Files Hair Straightener Lawsuit Complaint In Missouri Federal Court Against L’Oréal, SoftSheenCarson, Strength of Nature Global and Namaste Laboratories After Allegedly Suffering From Ovarian Carcinoma After Using Chemical Hair Relaxer Products.

On January 11, 2023 a woman residing in Jackson County, Missouri filed a lawsuit in the United States District Court for the Western District of Missouri, styled Tamara Sigars v. L’Oréal USA, Inc, L’Oréal USA Products, Inc. (“L’Oréal”), SoftSheenCarson LLC (“SoftSheen”), Strength of Nature Global, LLC (“Strength of Nature”), and Namaste Laboratories, LLC, (“Namaste”), Case No. 4:23-cv-00023, alleging, among other things, that she was diagnosed with ovarian cancer after using certain of the chemical hair straightener products developed, tested, assembled, manufactured, packaged, labeled, prepared, distributed, marketed, supplied, and/or sold by defendants including Dark & Lovely, Optimum, Motions, Organic Root Stimulator Olive Oil Relaxer, Soft & Beautiful, TCB, and/or African Pride.

According to the hair straightener injury complaint, plaintiff has had certain hair relaxer products applied to her hair dating back to approximately the year 1991 and continuing until 2010 and was diagnosed with ovarian carcinoma on or about February 10, 2010 at the age of 35. Plaintiff’s hair relaxer lawsuit reportedly alleges that her ovarian carcinoma was caused by her regular and prolonged exposure to phthalates and other endocrine disrupting chemicals (“EDCs”) found in certain chemical hair straightener products. Plaintiff further alleges that she underwent a laparoscopic hysterectomy in March 2010 at St. Joseph Medical Center in Kansas City, Missouri, subsequently underwent an additional surgical procedure on or about June 2010 at the University of Kansas Medical Center in Kansas City, Kansas and underwent numerous rounds of chemotherapy in 2013 and additional rounds of chemotherapy in June 2022.

The hair relaxer ovarian cancer lawsuit reportedly brings a 12 count personal injury complaint including claims for: Strict Liability – Failure to Warn, Strict Liability – Design Defect, Strict Liability – Manufacturing , Defect Negligence – Negligent Failure to Warn, Negligence – Negligent Design and/or Manufacturing Defect, Gross Negligence, Negligent Misrepresentation, Violation of the Missouri Merchandising Practices Act, R.S.Mo. §407.010 through §407.307, Fraud, Fraudulent Concealment, Breach of Express Warranty, and Breach of Implied Warranties.

The Plaintiff in the hair straightener ovarian cancer lawsuit reportedly seeks, among other things, a judgment against Defendants and past and future compensatory damages for pain, suffering, emotional distress, loss of enjoyment of life, and other noneconomic damages, past and future economic damages in the form of medical expenses, out of pocket expenses, lost earnings, and other economic damages, punitive and/or exemplary damages, pre and post judgment interest, and an award of attorneys’ fees and costs.
