Juul MDL Court Issues Order Governing Adoption of Master & Short Form Complaint For Juul Personal Injury Lawsuit Cases.

Juul MDL Judge Enters Order Relating to Master and Short Form Complaints for Juul Personal Injury Lawsuit Cases.

On March 27, 2020 the Court in the Juul MDL lawsuit proceedings issued an order governing the adoption of a master complaint and short form complaint for Juul personal injury cases.  According to the Order, the Juul short form complaint is an abbreviated form that each individual Plaintiff completes, indicating their individual claims, and adopting the factual allegations set forth in the Master Complaint as the basis for those individual claims.

The causes of action asserted in the Master Juul Complaint that purportedly may be asserted in a short form complaint (if applicable) include: (1) Strict Liability – Design Defect; (2) Strict Liability – Failure To Warn; (3) Strict Liability – Manufacturing Defect; (4) Products Liability – Negligent Design; (5) Products Liability –Negligent Failure To Warn; (6) Products Liability – Negligent Manufacturing; (7) Negligence And/Or Gross Negligence; (8) Negligent Failure To Recall/ Retrofit; (9) Negligent Misrepresentation; (10) Fraud; (11) Fraudulent Concealment; (12) Conspiracy To Commit Fraud; (13) Unjust Enrichment; (14) Violation Of Unfair Trade Practices/Consumer Protection Law; (15) Breach Of Express Warranty; (16) Breach Of An Implied Warranty Of Merchantability; (17) Wrongful Death; (18) Survival Action; and (19) Loss Of Consortium.
