Missouri Woman Files Chemical Hair Relaxer Lawsuit Case In Illinois Federal Court After Allegedly Suffering From Uterine Cancer After Using Motions, Dark & Lovely, Olive Oil Relaxer and Organic Root Stimulator Chemical Hair Relaxer Products.

On October 21, 2022 a woman residing in Waynesville, Pulaski County, Missouri filed a lawsuit in the United States District Court for the Northern District of Illinois, styled Jenny Mitchell v. L’Oréal USA, Inc, L’Oréal USA Products, Inc. (“L’Oréal”), Strength of Nature Global, LLC (“Strength of Nature”), Soft Sheen/Carson Inc., Soft Sheen Carson (W.I.), Inc. (“Soft Sheen”), Dabur International Ltd., Dabur USA Inc., (“Dabur”) and Namaste Laboratories, LLC, (“Namaste”) (collectively “Defendants”), Personal Injury Case No. 1:22-cv-05815, alleging, among other things, that after regularly using chemical hair relaxer products such as Motions, Dark & Lovely, Olive Oil Relaxer and Organic Root Stimulator, she was diagnosed with uterine cancer and underwent a hysterectomy.

According to the hair relaxer injury complaint, Plaintiff was allegedly exposed to phthalates and other endocrine disrupting chemicals in certain hair care products beginning around 2000, at or around the age of 10, when she began using chemical hair relaxers on her scalp, and continuing until March of 2022. According to the hair relaxer lawsuit, uterine cancer is allegedly associated with phthalate metabolites found in hair care products. The complaint further alleges that a study recently found that women who use chemical hair straightening or relaxing products allegedly have a higher risk contracting of uterine cancer.

The hair relaxer uterine cancer lawsuit reportedly brings a fifteen count complaint including claims for: Strict Liability – Failure to Warn, Strict Liability – Design and/or Manufacturing Defect, Products Liability – Negligent Failure to Warn, Negligence – Design and/or Manufacturing Defect, Negligence – Negligence and/or Gross Negligence, Negligence – Negligent Misrepresentation, Violation of the Missouri Merchandising Practices Act, R.S.Mo. §407.010 through §407.307, Violation of the Illinois Consumer Fraud and Deceptive Trade Practices Act, 815 ILCS 505/1, et seq., Fraud, Fraudulent Concealment, Breach of Express Warranty, Breach of Implied Warranties, Negligent Failure to Recall and Medical Monitoring.

The Plaintiff in the hair relaxer uterine cancer lawsuit reportedly seeks, among other things, a judgment against Defendants and compensatory damages for pain, suffering, emotional distress, loss of enjoyment of life, and other non-economic damages, economic damages in the form of medical expenses, out of pocket expenses, lost earnings, punitive and/or exemplary damages, pre and post judgment interest, a trial by jury and an award of attorneys’ fees and costs.
