The Family of a Child Who Was Alleged to Have Suffered Serious Brain Damage In a Hotel Hot Tub Accident Settles Personal Injury Lawsuit With Howard Johnson Hotel.
A confidential personal injury settlement was reportedly reached between Howard Johnson hotel and the family of a child that filed a lawsuit (styled Journey Hudson v. Great American Land Company, case number 30-2019-01052572-CU) in the Superior Court of California in Orange County claiming that the child was injured in an accident in which she nearly drowned in the hotel’s hot tub and allegedly suffered brain damage.
The personal injury settlement came after an Orange County Superior Court jury found that although the hotel was negligent, the negligence did not contribute to the accident. The defendants reportedly argued that the brain damage was caused by a viral infection unrelated to the child’s time in the hot tub. The plaintiffs in the brain injury lawsuit reportedly sought up to $68 million.

According to reports, the settlement was the result of a “high/low” agreement that the parties entered into before the trial commenced. A high/low agreement is essentially a contract in which a defendant agrees to pay the plaintiff a minimum recovery in return for the plaintiff’s agreement to accept a maximum amount regardless of the outcome of the trial.
