New York Couple Files Belviq Thyroid Cancer Lawsuit in New York Federal Court After Suffering From Thyroid Cancer

On June 11, 2020 a couple living in New York reportedly filed a Belviq thyroid cancer lawsuit in the United States District Court for the Eastern District of New York, styled Deborah Steinman and Reuben Steinman v. Eisai, Inc., Eisai Co., Ltd., Arena Pharmaceuticals GmbH, Arena Pharmaceuticals, Inc., Case No. 1:20-cv-02608 alleging, among other things, that the plaintiff used Belviq (lorcaserin hydrochloride) for the treatment of chronic weight management and thereafter suffered from thyroid cancer.

The Belviq throid cancer lawsuit reportedly alleges that the plaintiff first began using Belviq in or about November 2014, and used Belviq up through approximately February 2017 and that she was diagnosed with thyroid cancer in or about July 2018.  According to the Belviq suit, she sustained severe and permanent personal injuries, pain, suffering, and emotional distress.

The Belviq thyroid cancer case alleges that on February 13, 2020 the FDA reported that analysis of data from a study indicated an imbalance of cancer in patients taking Belviq that increased with treatment duration, including pancreatic, colorectal, and lung cancer.

The Belviq cancer lawsuit brings claims for alleged negligence, strict products liability, breach of express warranty, breach of implied warranties, fraudulent misrepresentation, fraudulent concealment, negligent misrepresentation, fraud and deceit and  loss of consortium.

The Belviq cancer lawsuit complaint reportedly demands judgment against the Defendants awarding compensatory damages to Plaintiffs for past and future damages, including but not limited to pain and suffering for severe and permanent personal injuries allegedly sustained by the Plaintiff, health
care costs, medical monitoring, punitive and/or exemplary damages, reasonable attorneys’ fees and costs.
