Estate of Pennsylvania Resident Who Died After Being Diagnosed With Pancreatic Cancer Files A Zantac Wrongful Death Lawsuit

On May 22, 2020, a wrongful death lawsuit was reportedly filed against various manufacturers and/or distributors of Zantac (ranitidine) in the United States District Court for the Southern District of Florida, styled Darlene Bowers, Individually, and as the Proposed Administrator of the Estate of Jerry Bowers vs. Boehringer Ingelheim Pharmaceuticals, Inc., et al.  v. Boehringer Ingelheim Pharmaceuticals, Inc., Sanofi-Aventis U.S., LLC, Sanofi US Services Inc., and Chattem, Inc., Case No. 20-cv-80828, alleging, among other things, that Plaintiff-decedent took Zantac OTC for approximately two years, was was diagnosed with pancreatic cancer on or around 2018 and suffered sudden death on August 31, 2019.

According to the Zantac wrongful death suit, Zantac, which belongs to a class of medications called histamine H2-receptor antagonists (or H2 blockers), which decrease the amount of acid produced by the stomach and are used to treat gastric ulcers, heartburn, acid indigestion, sour stomach, and other gastrointestinal conditions, may contain NDMA, a chemical that the EPA and the International Agency for Research on Cancer (“IARC”) have classified as a probable human carcinogen.

The Zantac wrongful death lawsuit reportedly asserts the following legal causes of action: strict liability (design defect), strict liability (failure to warn), negligence and gross negligence, breach of express warranty, breach of implied warranty, negligent misrepresentation and fraud, wrongful death and punitive damages.

The Zantac wrongful death case reportedly seeks economic and non economic damages, special damages, and general damages, including pain and suffering, disgorgement of profits, exemplary and punitive damages, an award of reasonable attorneys’ fees, court costs, and other litigation expenses and prejudgment interest and post-judgment interest.
